AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and Gamble Free ("we," "our," or "us") concerning your access to and use of the Gamble Free mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

DESCRIPTION OF SERVICE

Gamble Free is a self-help mobile application designed to support individuals in their journey to overcome gambling addiction. The App provides tools including a sobriety timer, savings tracker, motivational content, and an SOS feature for moments of urge. The App is intended to be used as a supplementary tool and is not a substitute for professional medical advice, diagnosis, or treatment.

IMPORTANT MEDICAL DISCLAIMER

ELIGIBILITY

You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you are at least 17 years old and have the legal capacity to enter into these Terms. If you are under 17, you may not use the App.

USER DATA AND ACCOUNT

The App uses an anonymized device identifier to sync your progress data. You are responsible for maintaining the confidentiality of your device and for all activities that occur through the App on your device. You agree to:

• Provide accurate information when using the App
• Use the App only for lawful purposes
• Not attempt to interfere with the proper functioning of the App
• Not attempt to access data belonging to other users

SUBSCRIPTIONS AND PAYMENTS

Subscription Plans

The App offers premium features through auto-renewable subscription plans. Available subscription options include:

• Monthly subscription
• 6-month subscription
• Annual subscription

Payment

Payment will be charged to your Apple ID account at confirmation of purchase. All payments are processed by Apple through the App Store. We do not have access to your payment information.

Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you originally paid.

Managing Subscriptions

You can manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation will take effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid period. No refunds will be provided for partial subscription periods.

INTELLECTUAL PROPERTY

The App and its original content, features, and functionality are and will remain the exclusive property of Gamble Free. The App is protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

PROHIBITED USES

You agree not to use the App:

• In any way that violates any applicable law or regulation
• To transmit any harmful, threatening, or offensive content
• To impersonate or attempt to impersonate another person or entity
• To interfere with or disrupt the App or its servers
• To attempt to gain unauthorized access to any part of the App
• To reverse engineer, decompile, or disassemble the App
• To use any automated means to access the App
• To collect or harvest any information from the App

DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the App will be accurate or reliable.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAMBLE FREE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your data

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Gamble Free and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or your violation of these Terms.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Gamble Free operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.

CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by updating the "Last updated" date at the top of these Terms. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gamble Free regarding your use of the App and supersede all prior agreements and understandings.

APPLE APP STORE TERMS

The following terms apply to your use of the App if you downloaded it from Apple's App Store:

• These Terms are between you and Gamble Free only, and not with Apple
• Apple has no obligation to provide maintenance or support for the App
• In the event of any failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if applicable); Apple has no other warranty obligation
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
